REQUEST FOR RELEASE
On or about February 12, 2016 the City of Lake Butler will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project that includes the relining of sewer lines and repair lift stations that are in a deteriorated condition. The project will also involve replacing aging components and equipment at the City’s wastewater treatment plant (WWTP). In addition, park improvements will be made at Lakeside Park and Westside Park to include new and renovated playground equipment, picnic facility renovation and related park improvements. Lakeside Park is located near the intersection of N. Lake Ave. and NW 3rd St., while Westside Park which is located at the northwest corner of SW 1st Ave. and SW 7th Ave. The sewer line & liftstation improvements will affect the following streets: SW 9th Place, SW 1st Terrace, and SW 10th Ave.; SW 7th Ave., SW 1st Way, SW 6th Place, and SW 2nd St; NW 7th Ave.; SE 11th St. and SE 5th Ave.; SE 5th Ave., SE 4th St., SE 6th Ave., SE 4th Ave., SE 6th St., and SE 3rd St. The WWTP improvements will include replacement of motors, pumps, valves, blowers, and connectors at the City of Lake Butler WWTP that is located at 15138 S. W. 81st Way in unincorporated Union County. The project involves the replacement or repair of existing infrastructure that is located in existing right of way that has been previoulsly disturbed. The project also includes the renovation of existing playground equipment and the installation of new playground equipment for small children at existing previously developed playgrounds. The project will be funded by a $650,000 Community Development Block Grant (CDBG), two $50,000 grants from the Florida Recreation Development Assistance Program (FRDAP) and $25,000 for sewer plant repairs to be contributed by the City of Lake Butler.
The City of Lake Butler has determined that the activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from the National Environmental Policy Act of 1969 (NEPA) requirements. Additional project information is contained in the Environmental Review Record (ERR) on file at City of Lake Butler City Hall, 200 SW 1st Street, Lake Butler, Florida 32054.
Any individual, group, or agency may submit written comments on the Environmental Review Record (ERR) to Dave Mecusker, City Manager at Lake Butler City Hall, 200 SW 1st Street, Lake Butler, Florida 32054. Additional project information is contained in the ERR on file at Lake Butler City Hall located at 200 SW 1st Street, Lake Butler, Florida 32054 and may be examined or copied weekdays 9:00 A.M to 4:00 P.M. All comments must be received by February 11, 2016. Comments will be considered prior to the City of Lake Butler requesting a release of funds.
RELEASE OF FUNDS
The City of Lake Butler certifies to the Florida Department of Economic Opportunity and HUD that Fred Sirmones in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Lake Butler to use the CDBG funds.
OBJECTIONS TO RELEASE OF FUNDS
DEO will accept objections to its release of funds and the City of Lake Butler certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Lake Butler; (b) the City of Lake Butler has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400 107 East Madison Street, Tallahassee, FL 32399-6508. Potential objectors should contact the City of Lake Butler to verify the actual last day of the objection period.
