These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Lawtey.

REQUEST FOR RELEASE

OF FUNDS

On or about March 30, 2015, the City of Lawtey will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to provide water treatment plant improvements to include the: construction of a well and all associated components; installation of high service pumps and all associated components; installation of electrical controls and all associated components; installation of yard piping control valves and all associated components; chlorination system improvements; and supporting water treatment plant building improvements.  Estimated funding includes $600,000 through the CDBG Program and $25,000 through local budgeted funds.

FINDING OF NO

SIGNIFICANT IMPACT

The City of Lawtey has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at Lawtey City Hall, 2793 Lake Street, Lawtey, FL 32058.  The ERR may be examined or copied during normal operating hours, Monday through Friday between 9:00 AM and 4:00 PM.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Lawtey, 2793 Lake Street/P.O. Drawer G, Lawtey, FL 32058.  All comments must be received on or before March 30, 2015.  Comments will be considered prior to the City of Lawtey requesting a release of funds.  Comments should specify which notice they are addressing.

RELEASE OF FUNDS

The City of Lawtey certifies to DEO and HUD that Jimmie Scott in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  DEO’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Lawtey to use the CDBG funds.

OBJECTIONS TO RELEASE

OF FUNDS

DEO will accept objections to its release of funds and the City of Lawtey’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Lawtey; (b) the City of Lawtey has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by DEO; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508.  Potential objectors should contact the City of Lawtey to verify the actual last day of the objection period.
