The permit authorizes a surface water management system on 7.0 acres for Florida Gas Transmission Company known as Compressor Station 16 Revision. The receiving water body is The New River. ORDINANCE NUMBER 2015 -0722
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF STARKE, FLORIDA AMENDING ARTICLE V, DIVISIONS 1 THROUGH 5 OF THE STARKE CITY CODE OF ORDINANCES; PROVIDING FOR THE IMPOSITION OF A 365-DAY MORATORIUM ON THE ASSESSMENT AND COLLECTION OF IMPACT FEES; PROVIDING FOR SEVERABILITY; PROVIDING DIRECTION TO STAFF; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT WITH THIS ARTICLE; PROVIDING DIRECTIONS TO THE CODIFIER; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, impact fees are an important source of revenue for the City of Starke, Florida to provide for adequate funding of infrastructure associated with growth and development; and
WHEREAS, the City of Starke, Florida previously adopted Ordinances 2007-0506, 2007-0507, 2007-0508, 2007-0509 and 2007-0510 on May 1, 2007 imposing impact fees on new development projects within the corporate limits of the City of Starke, Florida; and
WHEREAS, the aforementioned ordinances imposed impact fees for the purpose of improvements to road improvement, fire protection and rescue, police protection, parks and public building improvement infrastructure related to new development within the corporate limits of the City of Starke, Florida; and
WHEREAS, the adoption of said ordinances and the imposition of said impact fees permitted the City of Starke, Florida to keep pace with development by requiring that ongoing and future development contribute its share to the burden caused by said development on the existing and future infrastructure of the City of Starke, Florida; and
WHEREAS, a downturn in the national, state, regional and local economy resulted in the decline of development projects within the City of Starke, Florida; and
WHEREAS, this decline in construction and development projects has negatively affected local industries associated with growth and development and has caused increased unemployment within the City of Starke, Florida; and
WHEREAS, the economic health of these industries directly impacts the overall economy of the City of Starke, Florida; and
WHEREAS, the City Commission of the City of Starke, Florida has determined that the consequences of the economic downturn and the resulting decrease in the construction and development industry have reached a critical point and require action to stimulate the city’s growth-dependant industries; and
WHEREAS, the City Commission of the City of Starke, Florida desires to impose a temporary, 365-day moratorium on the assessment and collection of impact fees in order to stimulate the growth dependant industries within the City of Starke, Florida; and
WHEREAS this temporary, 365-day moratorium on the assessment and collection of impact fees is a reasonable, necessary and prudent response that will directly address this crisis and stimulate the City of Starke, Florida economy; and
WHEREAS, the City Commission of the City of Starke, Florida specifically finds that the adoption and enactment of this ordinance is in the best interest of the City of Starke, Florida and its citizens.
NOW THEREFORE, be it ordained by the City Commission of the City of Starke, Florida, as follows:
Section 1. Adoption and Incorporation of Recitals.
The City Commission of the City of Starke, Florida adopts and affirms the above-outlined recitals and incorporates them herein as a part of this ordinance by reference.
Section 2. Purpose and Authority for Ordinance.
This ordinance is adopted and enacted for the reasons outlined above and herein and is adopted and enacted pursuant to the authority granted the City Commission of the City of Starke, Florida by Article VIII of the Constitution of the State of Florida as well as Chapter 166 and Section 163.3201, Florida Statutes. .
Section 3. Amendment of the Starke Code of Ordinances.
A. Article V, Division 1, Sections 82-201 through 82-218 of the Starke Code of Ordinances, is hereby amended to include a temporary, 365-day moratorium on the assessment and collection of road improvement impact fees, beginning on August 6, 2015 and ending on August 5, 2016.
B. Article V, Division 2, Sections 82-231 through 82-248 of the Starke Code of Ordinances, is hereby amended to include a temporary, 365-day moratorium on the assessment and collection of fire protection and rescue impact fees, beginning on August 6, 2015 and ending on August 5, 2016.
C. Article V, Division 3, Sections 82-261 through 82-278 of the Starke Code of Ordinances, is hereby amended to include a temporary, 365-day moratorium on the assessment and collection of police protection impact fees, beginning on August 6, 2015 and ending on August 5, 2016.
D. Article V, Division 4, Sections 82-291 through 82-308 of the Starke Code of Ordinances, is hereby amended to include a temporary, 365-day moratorium on the assessment and collection of parks impact fees, beginning on August 6, 2015 and ending on August 5, 2016.
E. Article V, Division 5, Sections 82-321 through 82-337 of the Starke Code of Ordinances, is hereby amended to include a temporary, 365-day moratorium on the assessment and collection of public building improvement impact fees, beginning on August 6, 2015 and ending on August 5, 2016.
Section 4. Direction to City Clerk and Zoning and Building Department.
The City Clerk and the Zoning and Building Departments are directed to cease the collection of impact fees for road improvement, fire protection and rescue, police protection, parks and/or public building improvements during the moratorium period between August 6, 2015 and August 5, 2016, as established herein.
Section 5. Repealer.
All ordinances, or parts of ordinances, in conflict herewith are to the extent of such conflict hereby repealed.
Section 6. Directions to codifier.
It is the intention of the City Commission of the City of Starke, Florida that this ordinance shall become and be made a part of the Starke Code of Ordinances, and that the sections and paragraphs of this ordinance may be renumbered or relettered in order to accomplish such intentions.
Section 7. Severabilitv.
If any subsection, sentence, clause, phrase or portion of this ordinance is for any reason held or declared to be unconstitutional, invalid or void, such holding or invalidity shall not affect the remaining portions of this ordinance, and the unconstitutional, invalid or void provisions shall be deemed to have been severed herefrom, and the remainder of this ordinance, after the exclusion of such part or parts, shall be deemed to be valid, as if such part or parts has not been included herein. If this ordinance or any provisions hereof shall be held inapplicable to any person, group of persons, property, or kind of
property, circumstances, or set of circumstances, such holdings shall not affect the application hereof to any other person, property, or circumstances.
Section 8. Effective Date.
This ordinance shall become effective immediately upon passage.
