MODIFICATION

The Department of Environmental Protection (Department) gives notice of its approval of a modification to the Florida Mine Conceptual Reclamation Plan submitted by E.I. DuPont de Nemours and Company, Inc, PO Box 753, Starke, FL 32091. This conceptual plan (DU-F-CPB) modification is to update the existing conceptual reclamation plan boundary to include areas previously approved for mining under Environmental Resource Permit (ERP) modification # 0137482-005, and to update the post-mining land uses. Florida Mine is located in Bradford and Clay Counties, in portions of Section 31, Township 4 South, Range 23 East; Sections 1, 24, 25, and 36, Township 5 South, Range 22 East; Sections 6, 7, 8, 17, 18, 19, 30, and 31, Township 5 South, Range 23 East; Sections 5, 6, 7, 8, 17, 18, 19, 20, 29, 30, 31, and 32, Township 6 South, Range 23 East; Sections 1, 2, 12, 13, 35, and 36, Township 6 South, Range 22 East; Sections 1, 2, 11, and 12, Township 7 South, Range 22 East; and Sections 5, 6, 7, 8, 17, 18, and 19, Township 7 South, Range 23 East.. The mine includes land located in the St. Johns River and the Suwannee River watersheds, Class III waters. This application was reviewed pursuant to Chapter 378, Florida Statutes.

This action is final and effective on the date filed with the Clerk of the Department unless a petition for an administrative hearing is timely filed under Sections 120.569 and 120.57, F.S., before the deadline for filing a petition. On the filing of a timely and sufficient petition, this action will not be final and effective until further order of the Department.   2. Crops and Timber. All crops and timber growing, to be grown, standing, existing, severed from, or produced on, the Land. The foregoing items are jointly and severally referenced herein as the “Crops and Timber”;
  3. Leases, Rents and Income. All leases, written or oral, rents, issues, proceeds, profits. revenues, royalties, rights, accounts, accounts receivable and benefits in any manner arising from, relating to, or accruing from the Mortgaged Property, or any combination, including Borrower’s interest in and to all leases, licenses, franchises and concessions, including all amendments, modifications, replacements, substitutions, extensions, renewals, or consolidations. The foregoing. items are jointly and severally called “Rents and Income” in this instrument.
  4. Proceeds. All proceeds of the conversion, voluntary or involuntary, of any of the Mortgaged Property into cash or other liquidated claims, or that are otherwise payable for injury to, or the taking or requisitioning of, any Mortgaged Property, including all insurance and condemnation proceeds. The foregoing items are jointly and severally called “Proceeds” in this instrument.
  5. Contract Rights. Any and all contracts, written or oral, express or implied, now existing or hereafter entered into or arising from, or related to, the Mortgaged Property or the use, operation, sale, conversion, or other disposition of any interest in the Mortgaged Property, including, without limitation, any and all deposits, prepaid items, and payments due and to become due thereunder, and including, without limitation, construction contracts, service contracts, advertising contracts, purchase orders, and equipment leases. The foregoing items are jointly and severally called “Contract Rights” in this instrument.
  6. Other Intangibles. All contract rights, accounts, instruments and general intangibles, as such terms from time to time are defined in the Florida Uniform Commercial Code, in any manner related to the use, operation, sale, conversion or other disposition (voluntary or involuntary) of the Mortgaged Property, including all permits, licenses, insurance policies, rights of action and other choses in action.   7. Secondary Financing.
